When Building Permits Are Not Required

A building permit is not required for the replacement of an existing roof on a one- or two-family dwelling when performed by a listed contractor who adheres to the requirements. However, the construction should not involve a change in roof configuration or a change in the type of roof covering which could significantly increase the weight on the roofing structure.

Thanks to a recent change made by the New Jersey Department of Community Affairs, homeowners all over the state are now saving cash when they hire New Jersey roofing contractors to replace their roofs. While the update to state regulations was made more than a year ago , many people still arent aware that, in New Jersey, permits are no longer required for roof replacements, so we decided to share the news with our readers. Even though we love that this update saves our customers some money, there are some significant pros and cons to the change in regulations, so we feel its important to explore this topic in a bit more detail.

Historically, big projects such as roof replacements, additions, basement finishing, and major repair work have all counted on major home-improvement jobs. In most instances, the state requires that homeowners obtain permits to do the work. Why are permits required for home-improvement projects? you might ask.     Do I Need A Permit For A Roof Replacement Or Roof Repairs

    Permits were created to ensure building codes for installation, waste, and safety are followed. This protects you, your home, the workers, and any passersby!

    Most larger home projects require a permit! Because there are standards in place for construction plans, its especially important that you follow the permit guidelines.

    More specifically, many townships in Pennsylvania do not require a permit unless there is structural work being done with the roof replacement. Roof sheathing is considered structural, so if your plan is to replace the sheathing along with the other roofing materials, then a permit is most likely required.

    Building Jurisdictions May Base Permit Requirements On Size Of Area Being Repaired

    There are many building jurisdictions that exempt permit requirements for repairs, if the area is under a specific size, i.e. under 200 square feet or less than 1/10 of the total square foot area of the entire roof. Note the requirements may vary from one locality to another.

    If repairing a small area of a roof that is leaking, or one that has a few broken tiles or missing shingles, then the building department usually views this work as merely maintenance.

    New North Carolina Law Clarifies When Building Permits Are Not Required: Less Is More

    A new law took effect in North Carolina on October 1, 2016, and it affects the need for building permits. Session Law 2016-113, entitled An Act to Provide Further Relief to the Agricultural Community, clarifies in Section 13 that a building permit is not required for certain work costing less than $15,000 provided that the work is performed in accordance with the current edition of the North Carolina State Building Code.

    The new law – which amends N.C.G.S. 143-138, N.C.G.S. 160A-417 and N.C.G.S. 153A-357 – provides that no permit is required to conduct any construction, installation, repair, replacement, or alteration activities costing $15,000 or less in residential and farm structures if the work is performed in accordance with the current edition of the North Carolina State Building Code and involves:

    • Replacements of windows doors exterior siding or pickets, railings, stair treads, and decking of porches and exterior decks.

    • Plumbing replacements that do not change size or capacity.

    • Replacement of roofing.

    The law also provides that no permit “from any State agency” is required for:

    Who Can Get A Building Permit For Roof Replacement

    BUILDING PERMIT – Basic Requirements

    There are only two types of people who can apply for a building permit. The first is the homeowner. If the homeowner will be doing all of the work and not hiring outside help, they can apply for the permit themselves. However, if you will be paying someone to do the work for you, i.e., a contractor, the contractor will need to apply for the permit. Only a licensed contractor can apply for a permit. A general contractor can also apply for a permit that covers their subcontractors.

    How Do I Apply For A Roofing Permit

    When you want to apply for a roofing permit, you should be able to do so through the LADBS, which is the Los Angeles Department of Building and Safety. If you are looking to re-roof your home with any of the aforementioned roof coverings, you will need to apply for a structural permit, which is essentially the same as a building permit.

    The structural permits available at LADBS include:

    • An express permit
    • An expanded counter plan check
    • A regular plan check
    • A permitting process

    While the latter three options arent necessary for a roofing project, you may require one of the first two permits if you want to be able to eventually sell your home without running into any issues.

    If you decide to use one of the two materials mentioned previously, you should be able to obtain an express permit, which will allow you to apply online instead of going to one of the five LADBS offices throughout Los Angeles. Applying for an express permit is simple. Once you send in your online application, the permit should be approved or denied within a matter of 45 minutes.     When Is A Building Permit Not Required

    A building permit is NOT required for the following types of minor work for any type of existing building*

    * Excludes proposed and designated Chicago Landmarks and buildings in proposed or designated Chicago Landmark districts. For more information, contact the Historic Preservation Division in the Department of Planning and Development.

    Interior Work
    • Painting, wallpapering, tiling, carpeting, cabinets, counter tops, and similar finish work, without plumbing or electrical connections.
    • Drywall or plaster repair or replacement up to 1,000 square feet without alteration of plumbing or electrical devices or systems.
    • In-kind replacement of ceiling tiles that are not part of a fire-rated assembly.
    • In-kind replacement of interior doors that are not required to have a fire-resistance rating.
    • Temporary motion picture, television, and theatrical stage sets and scenery.
    • Nonfixed and movable fixtures, cases, racks, counters, and partitions not over 7 feet in height.
    • Interior repairs that do not involve any of the following:
    • The cutting away or removal of any portion of an exterior wall, interior wall, or partition, floor, or roof.
    • The removal or cutting of any structural beam, column, or load-bearing support.
    • The removal or change of any required means of egress or rearrangement of parts of a structure affecting the egress requirements.
    • Mechanical, electrical, plumbing, or fuel gas equipment or systems.

    Is There Structural Damage

    If a roof has structural damage from a wind storm, exceedingly large snow load, hurricane or a tree falls on the roof, then permits are usually required to do the roof repairs.

    Structural damage is generally considered more serious and may need a set of plans and an engineering review by the building department.

    Leaking over the long-term: damaged roof sheeting, rafters or trusses.

    Plywood or OSB roof sheeting can be badly damaged when exposed to moisture from slow and long-term leaks. Rafters and roof trusses may likewise suffer damage from these types of leaks. Wood rot and deterioration weakens framing members over time and some of the framing members may need to be replaced. Depending on the severity of damage, a permit may be required to repair and correct these problems.

    When not repaired for long periods of time, wood rot and mold and mildew may develop.

    Projects That Don’t Require A Permit

    When is a Building Permit Required?

    Many small projects and repairs do not require a permit. These include:

    • Replacing fixtures, cabinets, or flooring
    • Carry out non-structural maintenance and minor repairs to the exterior of your home
    • Painting
    • Replacing an existing electric powered hot water tank
    • Replacing defective fuses, receptacles, or switches
    • Installing roofing, gutters or drain-pipes

    Generally, you will be required to have a permit to begin construction, such as:

    • Any new construction
    • Changing the land use of an existing commercial space
    • Adding a secondary suite to an existing house
    • Renovation projects that include moving interior walls and/or existing plumbing, electrical, or gas lines
    • Structural repairs
    • Drywall repairs to fire separations in multi-unit residential buildings
    • Building or altering a garage, shed, or deck
    • Renovating or tenant improvements for a new or existing commercial space

    What Kind Of Permit Would I Need To Get

    In order to complete your application, youll need to know the contractors name and license number, project address and the owners name, project cost, type of roof material being removed and installed. They will ask if there is any structural work required for the project, too.

    Some permits are a flat fee and others charge based on the cost of the project per $1000. The borough youre in determines the cost of your permit. In Pennsylvania, We typically see a range of $50-$150 for roof replacement on a single-family home. There is a flat state fee of $4.50 added into your total fees.     The Office of Facilities Planning reviews plans and specifications and issues building permits for capital construction projects undertaken by public school districts and BOCES. Frequently, the Office is asked if a particular type of project requires such review, approval, and issuance of a building permit. This article defines which projects do and which projects do not require a building permit. There is no question that new buildings, additions, and reconstruction projects require a building permit. The question usually arises with regard to specific types of work and smaller kinds of facilities.

    New York State Department of State Regulations which implement the Uniform Code state that “Building permits shall be required for work which must conform to the Uniform Code.” The Building Code of New York State Section 101.2 enumerates the many types of work to which the Code applies. The very broad scope work listed would imply that any capital construction project would require a building permit. However, because certain categories of work may be excluded from the requirement for a building permit as noted in 19 NYCRR Chapter 32 Part 1203.3, this is not the case. By applying these exceptions and adhering to Building Code Section 101.2 the following list of project types which require building permits is derived.

    Why Do I Need A Licensed Contractor

    As we said above, only a licensed contractor can apply for a building permit. So if you dont have a licensed contractor, you wont be getting a building permit for roof replacement. That could be a big problem if a building inspector happens to notice your work. If an inspector sees that you are doing work without the required permit, they can order all work to stop until you get a permit. If your roof is torn up and has not been fully replaced, stopping work could leave you and your home unprotected. You or your contractor could also face a fine for performing work without a permit. In the worst case, you could be ordered to remove any work that was done without the necessary permit for roof replacement. In other words, you could be required to completely rip up your brand new roof.

    Window And Door Replacement

    Permits may be required to repair a roof, depending on the size of the area being repaired and the type of repairs. They may also be required when reroofing, depending on the local building jurisdiction.

    Homeowners and buyers should avoid jumping conclusions about whether a permit is required or not, for there may be consequences.

    Roofs In High Fire Risk Areas

    Homes built in areas that are considered high fire risk areas generally must meet higher standards and code requirements. Wildfire areas are invariably associated with strong winds and convection columns when fires occur and generally roofs on these homes require higher fire ratings and special installation therefore, building departments are more likely to require permits for major repairs and reroofing projects in these areas.

    Homeowners may be required to upgrade the fire rating of their roofs as well as change the types of roof vents and other penetrations to resist heat and embers.
